STATEMENT ON BOSTON AND DISTRICT ATHLETICS CLUB It has recently come to the attention of Boston Sports Initiative (BSI) (a charitable company) that members of Boston and District Athletics Club (BDAC) believe that BSI is acting in a way to seek the closure of BDAC. The Trustees of BSI do not seek the closure of BDAC and welcome all local clubs to use the facilities of the Princess Royal Sports Arena (the Arena). BDAC and its members are permitted to use some of the facilities, at certain times, under the terms of a tenancy granted by BSI. Unfortunately, BDAC has failed to pay the rent due to BSI since March 2007 and has failed to adhere to other terms of the tenancy on a number of occasions whilst using the facilities at the Arena. BSI has legal and statutory obligations in running the Arena and has to discharge these obligations to the whole of the local community who benefit from the facilities of the Arena. Consequently, in accordance with legal advice BSI has served a notice on BDAC, in compliance with its statutory obligations, giving BDAC 6 months notice of its intention to terminate the tenancy based on BDAC's persistent and continuing failure to pay the rent due under the tenancy. BSI cannot be expected to accommodate a tenant which consistently fails to pay its rent and whose behaviour at the Arena is disruptive to other users. BSI has acted entirely within its statutory rights in issuing the notice to terminate BDAC's tenancy of the Arena. |
